Who Can File A Wrongful Death Case In Missouri?

In Missouri, there are multiple groups eligible to file a wrongful death case, starting with immediate family members, as dictated by RSMo 537.080.

The specific groups eligible to bring a case are:

  • The deceased’s spouse.
  • The direct descendants of the deceased. This includes biological or adopted children, as well as illegitimate children.
  • The father or mother of the deceased.

Additionally, if there are no eligible individuals in this first class, a brother, sister, niece, or nephew of the deceased may also bring the case.

If there are no eligible individuals out of the above classes, the court may appoint a plaintiff ad litem, defined as any person the court deems suitable to represent the deceased’s interests.

Regardless of who files the case, any wrongful death legal action must be taken within three years of the deceased’s passing.
