Missouri $ 2 Million Settlement
CAUTHREN VS MCKINNEY PROFESSIONAL TRANSPORT
In February 2009, a truck driver for McKinney Professional Transport overturned her truck on Interstate 44. A passenger vehicle ran into the truck. Both the driver and passenger died. We represented the passenger’s family.
The defendant and its insurance company settled with the driver’s estate. The passenger’s family offered to settle their claim for the remaining policy limits but the insurance company refused the offer.
We set the case for trial. We intended to sue the defendant, receive a judgment, and then file a bad faith case against the defendant’s insurance company. Three days before the underlying trial, the insurance company offered to settle the underlying case and the future bad faith case. We ultimately settled the case for $2,000,000, which was approximately $1,300,000 over the remaining policy limits.
