ZINMASTER VS STANISLAW GIL AND NET TRUCKING

On August 21, 2005, at approximately 4:55 p.m. on westbound Interstate 80/90, Stanislaw Gil drove a 70,000-pound semi-tractor trailer truck owned by NET Trucking, Inc. into a construction zone on the Indiana Toll Road in Elkhart County, Indiana. He exceeded the speed limit for the construction zone and failed to pay attention to the traffic ahead. His actions caused a chain reaction collision involving six vehicles.

His semi-tractor trailer slammed into the rear of Beverly Zinsmaster’s vehicle. Beverly’s husband, Philip, was a passenger. This collision caused the Zinsmasters’ vehicle to hit the vehicle in front of it and spin off the road into a metal light pole. Phillip Zinsmaster died in the accident,
