KC Attorney Recovers Large Settlement for Man Who Died of Maggot Infestation at Missouri Nursing Home

Dollar, Burns, Becker & Hershewe’s nursing home abuse and neglect attorney, Rachel Stahle, recently recovered a large settlement of $800,000 for a man who suffered from severe neglect at a Harrisonville nursing home.

The man was a resident at a Cass County, Missouri, nursing home. During his time in the facility, he developed a serious leg wound. This wound was so badly neglected that maggots began to form. One of the facility’s nurses suspected maggots would form based on the appearance of and odor coming from the wound, but took no action to prevent this from happening.

Three days later, another nurse took off the wound’s bandage and copious amounts of maggots fell out. The nurse who failed to take action actively prevented the man from being sent to the hospital, even calling the man’s physician to talk him out of transferring the man after the family insisted on the transfer.

The man was subsequently transferred and was septic on admission. He died several weeks later from the wound infection.

The settlement represented the statutory cap plus paid medical bills.
