BRESETTE VS. BIRMINGHAM-SHUTTLESWORTH INTERNATIONAL AIRPORT
Attorney Tim Dollar of Dollar, Burns, Becker & Hershewe reached a settlement on behalf of clients Ryan and Heather Bresette and their children in a wrongful death case. The case was filed against Alabama airport contractors after the Bresettes’ 10-year-old son, Luke, lost his life in a tragic airport accident.
Returning from a vacation in Florida in March 2013, the Bresette family passed through the Birmingham-Shuttlesworth International Airport on their way home to Overland Park, Kansas. There, a recently installed flight display system fell on several family members, causing the death of Luke and seriously injuring his mother and two of his siblings.
A lawsuit was filed against parties involved in the design, construction and installation of the sign and who worked on the renovations at Birmingham’s airport, including contractors Brasfield & Gorrie and BLOC Global Services Group. These companies were part of a joint venture with architect KPS Group Inc. and sign manufacturer Fish Construction.
Through mediation, the case was settled Sept. 3, 2014. As part of the confidential settlement, the sign and others like it have been removed from the terminal and the Birmingham Airport Authority has commissioned a memorial of Luke to celebrate his young life. The Bresette family has created a foundation, Live Like Luke, in his memory.
