We represented an employee and settled his lawsuit against his supervisor and the supervisor’s insurance company. The co-employee suffered second degree burns after his supervisor lit a hand held blow torch and started a fire at a job site in Kansas. The co-employee sued his supervisor in state court.
The supervisor’s insurance company denied coverage and the supervisor retained his own private counsel. The co-employee and the supervisor agreed to a bench trial in state court. The day before the bench trial, the supervisor’s insurance company settled the case and all claims including the co-employee’s personal injury claims and potential garnishment claims and the supervisor’s potential bad faith and failure to defend claims.
